CREATING A PROVISIONAL PATENT

Provisional patents will contain a specification or description of your invention. They do not need to have any claims. It is best if they don’t. Provisional Patents are not reviewed by the patent office.
Once a provisional patent is filed, you have a year to file a complete patent (called a Utility Patent) but the priority date for your patent will be the date you file the provisional patent.

Construction of a provisional patent should be done carefully as it is considered part of the Utility Patent. MarLyn will work with you to make sure it does not contain hidden traps that can derail your Utility Patent if it gets to litigation.
